NORTHERNLINE® VINYL FENCE WARRANTY

Premium Fence (2022) Inc (“Premium”) is a customer-focused company serving the fence industry. Premium is committed to manufacturing the highest quality products and offers this Limited Warranty for its rigid vinyl NORTHERNLINE extrusions used in exterior fence applications.

1. Definitions

For the purposes of this Warranty, the following definitions apply:

Customer: The purchaser of Finished Products from the Fabricator.

Dark in Colour: Extrusions with an L-value of 60 or lower, per ASTM D4726 or an equivalent agreed standard.

White, Tan, Gray, and Khaki do not qualify as “dark in colour” Extrusions: Rigid vinyl lineal extrusions manufactured and sold by Premium to Client.

Client: The original purchaser of Extrusions for the purpose of installing finished fence products.

Finished Products: Products incorporating Extrusions, fabricated according to Premium’s recommendations and industry standards.

Premium: Premium Fence (2022) Inc and its successors and assigns.

2. Warranty Coverage

Premium warrants that, for a period of twenty (20) years from the purchase date, its Extrusions, when fabricated into Finished Products, will be free from manufacturing defects causing:

• Rotting
• Cracking
• Warping
• Corroding
• Peeling
• Blistering
• Non-uniform fading or discoloration

Dark in Colour Extrusions are warranted for a period of five (5) years only. (White, Tan, Gray, and Khaki do not qualify as “dark in colour”).

3. Exclusions

This Warranty does not cover:
Damage or defects caused by improper fabrication, maintenance, or installation.

Issues arising from:

• Chemical exposure (cleaners, pesticides, solvents, etc.)
• Heat buildup or unusual heat sources (BBQs, radiant heating)
• Atmospheric pollutants or environmental conditions
• Acts of God (fire, flood, storms, etc.)
• Improper air circulation or venting
• Use of non-Premium-approved paints, laminates, or coatings
• Use in windows or doors not installed on a vertical plane
• Color change due to normal weathering, including:
• Unequal exposure to sunlight and elements
• Geographic or environmental influences beyond Premium’s control

4. Conditions of Warranty

This Warranty is non-transferable and applies only if:

1. The Client provides a Customer warranty of equal or greater duration.
2. That Customer warranty is substantively consistent with this Warranty.

5. Claim Procedure

To submit a claim, the Client must:

• Notify Premium in writing within 30 days of discovering a defect.
• Provide a detailed description and any required supporting documentation.
• Allow Premium to evaluate the claim’s validity.

If the claim is accepted, Premium will, at its discretion:

• Refund the original purchase price or
• Replace the defective Extrusions (Client pays for return shipping).

Note: Premium is not responsible for labor, removal, reinstallation, or any incidental costs. (See relevant
installation warranty if applicable) Replacement does not extend the original warranty term.

6. Additional Terms

• Premium may discontinue or modify its Extrusions. If discontinued, compatible substitutes may be
  offered.
• Premium is not liable for:
  • Incidental, special, or consequential damages.
  • Implied warranties of merchantability or fitness for a particular purpose.
• No representative is authorized to alter or add to this Warranty.
• Clients must inspect Extrusions upon delivery and report obvious defects within 90 days.

7. Legal Rights
Some jurisdictions may not permit exclusion of certain damages. This Warranty grants specific legal rights; other rights may vary by region.
